Terms of Service

1. Acceptance of Terms

By downloading, installing, or using TrackSplit ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

2. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the Software on Mac computers that you own or control
  • Use the Software for personal, non-commercial purposes
  • Use the Software for commercial purposes (such as creating content for paid projects)

This license is for your personal use only. Each license is valid for use on up to 3 Mac computers owned by the license holder.

3. Restrictions

You may NOT:

  • Copy, modify, or distribute the Software
  • Reverse engineer, decompile, or disassemble the Software
  • Rent, lease, lend, sell, or sublicense the Software
  • Remove or alter any proprietary notices or labels
  • Use the Software to violate any laws or infringe on intellectual property rights
  • Share your license with others or use it on computers you don't own
  • Use the Software in any way that could damage, disable, or impair the Software

4. Intellectual Property

TrackSplit and all related materials (including but not limited to the user interface, code, documentation, and branding) are owned by us and protected by copyright and other intellectual property laws.

Your Content: You retain all rights to the audio files you process using TrackSplit. We claim no ownership over your input files or output files.

Third-Party Technology: TrackSplit uses open-source audio separation technology, licensed under the MIT License.

5. User Responsibilities

You are responsible for:

  • Ensuring you have the rights to process any audio files (e.g., you own the music or have appropriate licenses)
  • Complying with applicable copyright laws and regulations
  • Using the Software in accordance with these Terms
  • Maintaining the security of your computer and license

Important: TrackSplit is a tool for audio processing. The legality of separating and using stems from copyrighted music depends on your jurisdiction and intended use. You are solely responsible for ensuring your use complies with applicable laws.

6. Refund Policy

TrackSplit is available exclusively on the Mac App Store. Refunds are handled by Apple according to their refund policy. Visit reportaproblem.apple.com or contact Apple Support for refund requests.

7. Updates and Support

Your license includes:

  • Free Updates: All updates to the current major version of TrackSplit
  • Email Support: Technical support via email at [email protected]

We may release major new versions as separate products, which may require a new purchase or upgrade fee.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that:

  • The Software will meet your specific requirements
  • The Software will be uninterrupted, timely, secure, or error-free
  • The results of using the Software will be accurate or reliable
  • Audio separation quality will be perfect for all source material

Note: AI-based audio separation is inherently imperfect. Results vary based on the complexity and quality of source audio. Some artifacts or imperfect separation may occur.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Software
  • Any unauthorized access to or use of your data
  • Any bugs, viruses, or other harmful code transmitted through the Software
  • Any errors or omissions in the Software's functionality

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.

10. Termination

This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of these Terms.

Upon termination:

  • You must cease all use of the Software
  • You must delete all copies of the Software from your computers
  • You retain ownership of any audio files you created before termination

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date. Your continued use of the Software after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
